Il presente articolo si concentra sul nesso del tutto particolare che sussiste tra Bestimmtheit e Entschiedensein con riferimento al concetto di legge così come si trova illustrato da Hegel, in particolare all’interno della Filosofia del diritto. Secondo Hegel il concetto di legge tiene insieme la forma della sua determinatezza universale e l’inevitabile arbitrarietà del suo contenuto. L’articolo cerca di indagare tale nesso studiando lo sviluppo concettuale di due differenti figure che giocano un ruolo cruciale nella Filosofia del diritto hegeliana: il giudice e il re. Il testo hegeliano verrà analizzato alla luce delle teorie di Simmel, Schmitt e Kelsen, con l’obiettivo di comprendere quale sia il peso relativo della forma e dell’arbitrarietà della decisione all’interno del concetto di legge.

The present article focuses on the peculiar relationship which exists between Bestimmtheit and Entschiedensein in relation to the concept of law, as illustrated by Hegel particularly within his Philosophy of Law. According to Hegel, the concept of law holds together the form of its universal determination and the inevitable arbitrariness of its content. The article tries to investigate this relationship by studying the development of two different figures which play a key role in Hegel’s Philosophy of law: the judge and the monarch. This work will be analyzed in the light of some different theories by Simmel, Schmitt and Kelsen, in order to understand the importance of form and arbitrariness of decision within the concept of law.
